Success to All India Agro Input Dealers Association's demand
ATM News Network: The demand of All India Agro Input Dealers Association to grant pesticide business license to his relative in case of death due to any reason has been accepted. According to this demand, the Union Ministry of Agriculture and Farmers Welfare has proposed to withdraw the ordinance and make provisions in Section 14 of the Pesticides Act, 1971, informed Sanjay Raghuvanshi, national spokesperson of the association.
A delegation led by National President of All India Agro Input Dealers Association, Manmohan Kalantri met Union Agriculture Secretary Manoj Ahuja and made various demands in this regard. It was demanded that in case of death of pesticide trader, license should be given to his next of kin irrespective of educational qualification. It is mandatory to provide for the transfer to continue the business of the deceased businessman.
Keeping this demand in mind, the Central Government vide Ordinance No. GSR 406 (E) dated 30th May, 2023 has proposed to make such a provision in Section 14 of the Pesticides Act, 1971 on the death of a licensee.
These rules may be called the Pesticides (Fifth Amendment) Rules, 2023, as per the notification of the Ministry of Agriculture. These rules shall come into force from the date of their final publication in Official Ordinance. The new provisions shall come into force after the first proviso in sub-rule (1) of rule 14 of the Pesticides Rules, 1971.
As per the new provision, in case of death of an existing retailer or dealer, the family members of the deceased retailer or dealer should submit the death certificate of the deceased retailer or dealer to the licensing authority for enforcement of the Succession Act during the license period. After submitting it, you can apply for permission to transfer the license in the name of a relative.
However, non-educated family members of the deceased retailer or dealer will have to complete a certificate course in pesticide management for transfer of licence. The license may be temporarily transferred to a family member for a period of one year until he completes a certificate course in pesticide management. During this period the applicant can employ a person having the prescribed educational qualification.
In this regard, objections and suggestions have been invited from the affected within 30 days, after which this final ordinance will be issued and converted into law. This implementation will provide relief to the existing traders and their families.
